The World's Most Popular Board Games

Board games have been in existence over centuries ago. The oldest known board games trace as far back as 5870 B.C. This just proves the human necessity to be entertained and challenged at the same time. Board games, more than any, requires mental strategizing. Unlike sports, where the mind is challenged as well but concentrates more on the physical capabilities of the player, board games requires the competence of the player's thinking process and quick-wittedness to win. This is one of the attributes that set apart board games from many other games.

Board Games Live and Die

This does not mean, however, that all board games are successful. Board games live and die depending on their popularity. If there is an art in playing them, there is even greater art required in creating them. Senet and Mehen are board games traced back in ancient Egypt, but their existence in contemporary or popular culture is almost nonexistent, but their evolution can be more recognizable today. Truth to be told, it is the applicability of the game towards the modern times that, most of the time, decides if the game will live on or wither away.

Grandparents of Board Games

Backgammon, Go and Chess are probably the oldest games still played today. Backgammon is considered as a race game. It requires moving one's pieces across to the other side of the board. This game needs to roll dice to determine the moves of the game. This game dates back to ancient Egypt, around 3000 B.C., and it's believed to have evolved from the ancient game of Senet.

Go is believed to have originated in China back in mid-2000 B.C. specifically, it can be traced to Emperor Yao, and subsequently its popularity spread to Korea and Japan. Chess, on the other, was believed to have originated in India in the 6th century. Scholars consider chess to have evolved from an ancient game called Chaturanga.

Clearly Go predates chess a few thousand years back, but they have their similarities. Each only requires two players, and they have to outwit one another. It is not surprising to know that chess originated from India, a country that shares a border with China. However, one glaring similarity both Go and chess have is that they are both war games.

Ancient forms, yes, and nearly incomparable to the war strategy games modern times have to offer in video games. It is believed that both these games came from tribal warlords who used same looking pieces to strategize their attack plan.

In retrospect, having war games as the oldest, still popular board game in present times does give people an idea why it is still applicable today.

Modern Times, Contemporary Board Games

There have been countless board games that have come into existence in our time. But little have the shelf life as the most popular board games still being played today. The exclusive list includes:

* Checkers

* Scrabble

Of course, Monopoly is almost recognizable across the globe. This is strange because Monopoly isn't exactly the easiest game to understand. Yet, despite this, the Guinness Book of Records recognizes Monopoly's worldwide appeal, with over 750 million having already played the game. To think that it has been in existence since 1935, Monopoly's staying power is a testament how real estate, business, banking, and investment is applicable in our times.

Clue, on the other hand, relies on murder and mystery to keep players interested. Risk is a perfect example of how ancient games like chess came about and Go have evolved to adjust to their cultural environment. Life, in contrast, predates Monopoly. It was created in 1860 and simulates, well, life. Marriage, career, and so on are part of the game, and people find it enjoyable to imagine what life would be like, or what life could have been, in this game.

Snake and Ladders is also another popular board game. The trouble with this game is many adults do not find it appealing. That is why it is nearly exclusive only to children. Adults normally find games depending on chance boring. Relying solely on the dice to determine the player's fate is not as challenging as most adults would want from board games. The player's fate in Monopoly is also determined by the dice, but unlike Snakes and Ladders, it still requires players to strategize.

Checkers, or English draught, is another popular game believed to have stemmed out from the form of chess and Go. Still, it is still considered as one of the most popular board game today. In fact, it is more popular than Go, which is commonly associated with Japan.

Lastly, there are the word games. Scrabble is the most popular among all word board games. Like chess or checkers, there are even world competitions for Scrabble. Word Factory, which can be loosely considered as a board game, is also a popular word game.

Tips To Baby Care Things You Should Know

Wonderful moment has arrived ? you had a baby! Now what? Caring for your baby is a skill, lucky us it can be easily acquired and learned.   • Talking to, touching, and holding your new baby in the delivery room is good for you and your baby.
  • This is a wonderful time to start breastfeeding. Tell your care giver not to let anyone else feed your baby so that your baby will only get your breast milk.
  • Your health care giver will examine your baby right after birth, checking appearance and color, reflexes, breathing, heart rate, and activity to see whether your baby needs any special care.
  • Ask to have your newborn placed beside you in bed. Touch and hold your baby, and get to know how your baby feels.
  • Your baby may look different from the way you expected. Ask the hospital staff if you have questions about the way your baby looks.
  • Ask the staff to show you how to take your baby?s temperature and read the thermometer.
  • All infants should be protected against hepatitis B. Some doctors recommend the first shot be given before going home from the hospital.
  • You should take your baby to see the doctor when your baby is about 1 week old unless you are told to come in sooner. Call your baby?s doctor right after your baby is born for an appointment.
Before you and your baby leave the hospital, a few drops of blood will be taken from your baby?s heel to check for some rare problems.

You will need a car safety seat (marked ?federally approved?) to bring your baby home. It is the law?your baby must always be in an approved safety seat when traveling in a car, van, or truck. Ask your health care giver, the hospital where you deliver, or health department about programs that loan federally approved car safety seats.

If you or the baby?s father have any questions about how to pick up, hold, feed, bathe, diaper, or dress your baby, ask the hospital staff to help you. Your new baby needs all of the love and comfort you can give. You cannot love a baby too much. Your entire family can share in the joy of this love.

Caring for your baby at home ?

Most newborn babies spend most of their time sleeping and eating. You want to make sure that baby has a safe place to sleep and is put to sleep in a safe position.

A safe crib will have slats no more than 2 3/8 inches apart and corner posts less than 5/8 inch high above the rails.

Baby should sleep on a firm mattress that fits tightly in the crib, cradle or bassinet.

Do not put pillows, comforters or other soft padded materials in the bed under the baby.

Put healthy infants to sleep on their backs or sides.

Keep the sides of crib raised when baby is sleeping in it.

Try to keep sleeping newborns away from pets, other children and large overstuffed toys.

Don?t let people smoke around your baby. Your baby?s lungs are delicate. Babies are not as resistant to respiratory infections as their parents.

That old Rolling Stones tune, ?I Can?t Get No Satisfaction? could have been sung by those seeking to buy homes during the real estate bubble of a year ago, and more, which of course has been bursting ever since.

At that time, it was a seller?s market, and multiple buyers frequently offered more than the official asking prices because there was so much demand and so little supply.

Now, we may be on the threshold of a true buyer?s market, with home prices that reportedly have taken a 10% dip in the last year, alone.

Still, buying your dream house is difficult in any market. It just seems hard to find all of the practicality and frills you need and can afford in a single dwelling.

But instead of abandoning hope, I suggest you relax and consider my spin on an aphorism that I once heard, and you may have, too:

The market is telling me this is a good time to start looking, and I have. But I?m not really ready to move, yet, so I expect I?ll see some decent listings, but in a few months that one-of-a-kind, must-have beauty will come along, and we?ll live happily ever after!

Playtime Is Meant To Be Fun And Safe: How To Make It That Way

Playtime is important in the development of a child?s imagination and social skills. However, how a child plays and what the child plays with is equally as important. Playtime should be safe for the child and age appropriate. It should also be fun and encourage imagination. Parents can do several things to help ensure their child?s safety when playing.

To ensure safety during playtime, it is important for parents to choose the correct toys. It is very tempting to always buy the latest, greatest popular toy on the market or to buy your older child the fun technology oriented toys that are so prevalent. However, a parent should be aware that there are certain physical and developmental dangers in choosing certain toys or allowing too much access to particular toys. Safety starts at the toy store with parents and caregivers choosing toys that are safe and age appropriate for the child.

?Look at the design of the toys to ensure they are well made and will not break easily.

?Toys that are very small can be a choking hazard for young children. Even if you do not think your child will put a toy in their mouth or lodge it elsewhere, do not choose these types of toys for small children. It only takes a moment for a fun toy to become a hazard.

?Do not buy toys that have loud noises that can potentially impair hearing.

?Toys that propel objects can be a danger to eyes. If older children have such toys, make sure they are not accessible to the younger children in the house and that the older children do not play with these in the vicinity of younger children.

?Watch out for toys that have sharp edges, small parts, or sharp points. Avoid toys that produce extremely loud noises that can damage hearing and propelled objects that can injure eyes.

Today, many children are exposed to large amounts of television, computers and video games. While these items can be helpful in learning certain skills, too much exposure to them will quell a child?s imagination. Make sure to limit television time and allow children to use their imagination. Playtime outside is also healthy for the child. Let the child run and play and toss a ball around so they can practice motor skills and get some exercise. Parents should get involved.

?Play games with your children. This will help teach sharing, taking turns, patience and rules. Card games, puzzle games and board games are a great way to interact. If you are in a car together, play games such as ?I Spy?.

?Create imaginative activities such as putting on plays or musicals. Playing dress up or house with your child can expand the imagination and can be a lot of fun.

?Play with action figures, stuffed animals and dolls with your children. This can add to social interaction by giving the child the tools to act out what the feel is appropriate and you can guide them by teaching appropriate play and manners.

?Sing songs with your children. Children love to sing and it can be fun for everyone. It is also a great opportunity to learn the alphabet and rhyming.

Budgeting Ideas For Mother And Baby


The good news is that there are ways to effectively budget and save that can greatly reduce these costs. You will find with smart shopping and good planning, you can still provide everything that your child needs while saving a great deal of money in the process. Here are some cost-saving tips that are sure to take some of the strain off of your bank account:


Dont feel that you need to buy everything at once. Your baby will not need to much more than an infant car seat, a safe place to sleep, diapers, and a few changes of clothing for the first few weeks.


Consider breastfeeding. You can save considerably if you dont have to buy formula and bottles.


Buy nappies on sale and in bulk, or better yet, buy a few dozen reusable cloth nappies that can be worn and washed over and over.


Dont be embarrassed to accept hand me downs from friends and family or shop in resale stores. You might be surprised to find that much of the clothing and toys have hardly been used at all.


Dont always assume that the more expensive items are better quality. Ask a trusted family member or friend who has small children what brands they like and use.


Shop the end-of-season sales for baby clothing and stock up on sizes that youll need for next season.


Water Balloons


This is a great activity for children, teenagers and even parents to do together. Buy a bag of water balloons and fill as many as you can. Place in plastic buckets or washing up bowls. Small children will need help. After everyone has an equal amount of wobbly, jiggly balloons, go into the garden and let the water fight begin! Hosepipes and water guns are not allowed. Wearing funny goggles, bathing caps, snorkels and NOT changing into bathing costumes makes it even more fun. The more spontaneous the better. Simple safety rules should be laid down first i.e., no running in the house, balloons must not be aimed at chest or head etc., Everyone will be laughing and having a great time, especially if grownups get involved. Afterwards, the children can go on a treasure hunt to see who can collect the most pieces of broken balloons in the garden - we don't want birds, dogs or cats to choke on any bits of rubber left in the garden.


If you have internet access log on to large coach company websites to find special deals: on one its possible to pre-book to any destination for ?1 each way per person. You have to be specific about times outward/return etc. This is a cheap way of introducing your children to different cities and having fun. Do your homework on your chosen destination and find out free venues and events. Pack a lunch and get discovering!!


Save up your vouchers from supermarket point systems and exchange them for days out tokens. This is a cheap way of affording expensive days out at theme parks as the vouchers are often worth more than their money equivalent.


Evaluate how much youll be spending for childcare if you are returning to work. You may just find that its less expensive to stay at home with your child.


Explore options to work from home to eliminate childcare costs.


Begin a higher education savings plan early on and contribute to it on a regular basis.

Today, Norm Goldman, Editor of Sketchandtravel.com is excited to have as our guest, Nancy Pfeiffer, founder of Adventure Travel Media Source. 

Good day Nancy and thank you for agreeing to participate in our interview. 

Norm: 

Nancy, could you tell us something about yourself and how did you become interested in setting up Adventure Travel Media Source? 

Nancy: 

I had been doing general marketing consulting for a variety of clients, including guest ranches, river rafting companies and B&B's.  In the course of this, I realized over many years that the best thing I could do for them as far as marketing was to get editorial coverage for them.  I eventually made the decision in 1999, to switch to doing media relations exclusively.  That's when ATMS was born. 

Norm: 

What are the principal objectives of ATMS? 

Nancy: 

To obtain quality editorial coverage for our clients in targeted publications.  To provide employment for a team of talented people and allow them to grow and develop skills in the media relations environment.  To serve the publishing industry by providing them access to and information about unusual trips and destinations; and to be a participant in the global community of adventure travel and ecotourism. 

Norm: 

Have you found that adventure travel today is much more popular than it was several years ago, and if so, what do you attribute this to? 

Nancy:  

Adventure travel has become a very popular form of travel, making it the fastest-growing segment of the travel industry for the past 5-7 years, according to various industry specialists.  Adventure travel takes many forms and can mean anything from a bus tour through a national park to extreme mountain climbing in Nepal.   

The reasons for this are many including the fact that the baby boom generation has had access to travel during their lives.  They tend to be well education, high wage earners and very curious about the world around them.  These tendencies make them a natural for adventure travel where they can do such things as: a cooking school in Provence, a bike tour of the Canadian Rockies, a safari to Kenya, an adventure cruise to the Galapagos, a backpacking trip in Moab, skiing in Jackson Hole, wildlife expeditions to Churchill, Manitoba to view Polar Bears, a Native American guided tour of the Ute Tribal Park, etc.   

No more are travelers content to drive through Glacier National Park- they now want to hike the glaciers, view wildlife and learn to fly fish on their vacation.  These factors have led to the genre of adventure travel. 

Norm: 

No doubt, you have experienced many adventure experiences. Which ones would you consider to be your favorites and why? 

Nancy: 

My personal favorite adventure is whitewater rafting.  I did not begin adventuring until I was 40 and recently divorced.  I took my first week-long rafting trip on the Main Salmon River in Idaho with a client.  I was frightened to death and determined that I would do it and survive. 

I did survive the River of No Return and have now done that trip 13 times as well as the Middle Fork of the Salmon, many stretches of the Colorado River as well as other rivers. 

River trips are wonderful because they include many other elements such as hiking, fly fishing, wildlife viewing and camping.  I also enjoy hiking, camping and fishing with my husband, riding horses, snowshoeing  really anything that takes place outdoors, in nature, and involving some activity or personal challenge.  I'm a 58-year-old grandmother and if I can do it, anybody can! 

Norm: 

Readers of Sketchandtravel.com are always on the lookout for unique romantic getaways. Would you be able to recommend five adventure tours that you would not only consider to be adventurous but also romantic? 

Nancy: 

  • Lapa Rios Eco Lodge in Costa Rica is a spectacular and romantic destination.  It is located on the Osa Peninsula of Costa Rica so there is plenty of surfing, wildlife tours, hiking and water sports available right outside your door. Activities at Lapa Rios are focused around the rainforest and the nearby Ocean.   Rainforest hikes, bird watching, Ocean Kayaking, horseback riding, catch and release sport fishing and surfing are some of the activities offered.   Furthermore, guests can take massages, participate in Yoga classes, relax at the pool with a tropical cocktail or just take a nap in a hammock and maybe observe the birds, monkeys and other animals that come by.   For many guests, the highlight is a tour to Corcovado National Park by plane or a night camping in the jungle. 
  • The Ashley Inn in Cascade, ID is the most beautiful Inn I've ever visited  it's so sweet and romantic with a fireplace in every room, a spa tub with lighted waves for soaking, very feminine dcor and the most attentive staff anywhere.  And, you can board the historic Thunder Mountain RR line right behind the Inn for a trip that follows the Payette River Scenic Byway.  There are dozens of creeks and rivers for fly fishing, Lake Cascade 2 blocks from the Inn. Its Idaho's own little mountain kingdom  perfect for a romantic getaway. 
  • Canyon Villa in beautiful Sedona, AZ, is located right on the border of the Coconino National Forest.  Of course, everyone knows that Sedona is a getaway for the rich and famous and you don't have to be rich OR famous to stay at this beautiful Inn.  It's a hideaway just for the two of you and when you're ready to peek outside your door, you are surrounded by the red rock beauty which beckons you to come out and play.  Options include jeep tours, horseback riding, golf, tennis, and spas, biking, hiking and shopping at Tlaquepaque, a unique arts and crafts village with shops, galleries and fabulous restaurants. 
  • Brooks Lake Lodge in Wyoming's NW Corner, just outside Grand Teton National Park, is a very special place.  Listed on the National Register of Historic Places, the Lodge is secluded in winter only reachable by dogsled, snow coach of x-c skis.  Their lodge rooms and individual cabins are so cozy; you will just want to snuggle together with a cup of hot chocolate or a special bottle of wine.  Gourmet food is prepared by the four star chef and a winter wonderland awaits you when you want to be active.  To top it all off, Brooks Lake Lodge just added complete spa facilities, so you can share a couple's massage to soothe those sore muscles after a day of play.  The Lodge is open in summer as well but nothing compares to the winter getaways at Brooks Lake Lodge. 
  • Hidden Creek Ranch in Harrison, ID, just outside Coeur d'Alene is a dude/guest ranch second to none.  The cabins offer the perfect retreat for the two of you, all decorated in Native American style.  Gourmet food and wine are served in the dining room; horseback riding takes guests through forests and up the mountainsides each day.  Hot tubs are discreetly positioned behind the cabins for late night soaks under the moon.  A very well-trained staff will attend to your every need.  Each Wednesday evening, owner, Iris Behr, leads a special program of Native American ceremonies, including a pipe ceremony and a traditional sweat lodge.  What a wonderful way to connect with your spouse or lover than to share such an intimate evening.  Massages are available as well as yoga and meditation classes; fly fishing lessons, an adventure challenge course and much more await you at this beautiful Ranch.

What does travel mean to you? 

Nancy:  

Travel is an exploration, a learning experience and an opportunity to refresh and restore my spirits through trying new things, meeting new people, etc. 

Norm: 

How many months of the year do you devote to travel? 

Nancy: 

It varies, according to my business, but counting both business and leisure travel, probably about 5-6 months are spent on the road. 

Norm:

Be sure to go with a reputable outfitter or operator.  Try something you've always wanted to do the options are limitless!  Ask for references from others who have traveled with the company you are considering booking with.  The company will provide you with lists of what to wear, what to bring and what to expect.  If they do not answer your questions and treat you with courtesy and kindness go to someone else. 

There are resources out there that provide professional credentials to outfitters America Outdoors, the Dude Rancher's Association, etc.  They will work with you to find the right trip and the right outfitters or operator.

Home Appreciation Slows to Lowest Rate in Nine Years

Existing home sales fell 1.3% in June, according to the National Association of Realtors. This marks the eighth decline in 10 months.

June's average price of a sold home increased 0.9% from the year prior, to $231,000. This is the smallest year-over-year price increase since May of 1995.

Regionally, June's sales were down 3.5% in the Northeast and 2.3% in the South, while sales in the West and Midwest remained steady.

The supply of unsold homes has risen to a record 3.725 million units. The inventory is a 6.8 month supply at June's sales rate -- the greatest amount of time in over eight years.

Single-family home sales were down 0.9% to a seasonally adjusted rate of 5.81 million units, whereas sales of condominiums fell 5.5% in June.

David Lereah, NAR chief economist, says that home sales are beginning to level out after five years of record sales. With interest rates increasing, housing sales have slowed.

Lereah suggests that there are two markets seen in the industry right now -- one where red-hot markets are cooling, and the other where moderately priced areas are starting to heat up.

The NAR reports that sales have decreased in New York, Boston, Minneapolis and Chicago, but have increased in Syracuse and Pittsburg.

Overall, sales are increasing in Texas, Georgia, North Carolina and Tennessee, while decreasing sales are seen in Maryland and Virginia.

What's more, entrance to the museum is through a mock-up of a cobbled London street typical of the kind which surrounded this part of London when Chelsea FC was originally formed in 1905.

Private Annuity Trust vs. 1031 Exchange When a PAT Makes Sense (Part II)

In the last article, I pointed out when, as a real estate investor, doing a 1031 Exchange on the sale of a Real Estate Property may not be your best option.

So, let's assume you do want or need to sell a real estate investment, don't want to do an exchange, and don't want to pay a huge lump sum capital gains tax payment of 15-40% on your gains. Now is the time to see how a Private Annuity Trust can save you money.

It's important to know that you don't avoid paying your capital gains tax obligation, you just get to defer all payment for a while if you're under 70 years old, or you at least get to spread out the obligation over many years. The total of years can be your lifetime or a fixed number of years determined by you when you set up the trust.

So, how does that help you? Well, if someone were to offer you a 0% interest loan on let's say $300,000.00 for the next 30 years, and you only had to make minimum payments, would you jump at the chance? Most people sure would. Think of how you could invest that 300K so that you could enjoy the benefit of the interest it accrued. This is effectively what a Private Annuity Trust does for you. It allows you to keep most of your gains working to your advantage, while paying back the money owed to the IRS over a long period of time.

This also holds for the depreciation recapture if you owned your property for a long period of time and depreciated it according to a schedule to realize annual tax advantages of owning investment real estate.

If you do not put a tax strategy in place and sell outright, not only do you owe capital gains tax, but you also owe depreciation recapture, which can be another 25-35% of your total depreciation taken over the ownership cycle of your investment.

And, you will avoid the possibility of the dreaded Alternative Minimum Tax trap. This is something else that may catch you by surprise when you least expect it triggered by your outright sale of property. This could mean having other legitimate tax deductions disqualified and a higher tax payment owed by you.

As you can see, it's definitely worth it to consult with an expert in Capital Gains Tax saving strategies before you make the decision to sell your real property.

The PAT can also work with the sale of a second home, vacation home, or even your primary residence. With these assets, a 1031 exchange is not an option.

How to Choose the Right Paper Part 1

Choosing the right paper for your project is more complex than just picking the most expensive sheet and keeping your fingers crossed.

In fact, you shouldn?t think about choosing paper based on the highest quality available, or the highest quality you can afford. Rather, you should figure out the most appropriate quality paper for your needs because most appropriate equals best.

The point is -- no one sheet fits every project. Paper is complicated. It is three-dimensional and, in addition, no two print jobs are ever alike. The ink coverage, batch of paper, and moisture in the air -- all will affect the production of a printed piece.

We?ve compiled our top ten tips to help you find the right paper for your projects and here in Part 1, are 3 priorities to consider when making your selection.

Consider Paper Early On
As soon as the preliminary design is done, spec your paper and get quotes from printers. Tell your printer you are open to suggestions, not substitutes, but suggestions.

Depending on the sheet size your printer plans to use, small changes like 1/16th of an inch in the width of your piece can sometimes make a big difference to allow the job to fit better on the sheet. At this stage, you can still make small adjustments to the design, but not when the client has signed-off on the final proof.

Getting your quotes early will also make you aware of any turn-around times you should consider in your deadline. Make adjustments if the paper you have specked is readily available from your local merchant (1 day) or has to be shipped from the mill?s warehouse (2-5 days).

A lot of mills also offer custom sheet sizes to minimize your paper waste and help you save on your overall paper cost. But you need to know early, which paper you want to print on, as these orders can take anywhere from 5-14 days.

I know paper availability is a big concern for many of you, so we will have an extra Paper Tip about this in a week or two.

Personality
Consider the life span of your printed piece. Is it a direct marketing piece, that on a good day, 5% of the recipients will look at? Or does your piece have a longer life span like an annual report, a marketing brochure or catalogue?

The personality of your piece, its life span, texture, color and coating determine the price range and quality of your paper, in addition to your budget.

Ask yourself what impression the piece should make. A non-profit organization asking for financial support sends a mixed message when its mailer is printed on a premium stock. Premium paper suggests luxury and the recipient may think, ?why bother, they seem to have enough money anyway.?

If you are printing a job that reflects environmental issues, choose papers with recycled content, visible fibers or a mixed composition with a lower brightness and a texture that conveys the environmental feel.

For projects that suggest luxury, metallics, iridescents, suede, leather and other specialty papers create a stunning first impression.

Finish
When designing a piece, we designers have a very clear idea of what kind of finish will enhance our design. Some designs ask for gloss, some need a matte finish -- don?t mess with us, we know what we want.

If color and crisp image or photographic reproduction is your concern, a coated gloss, matte or silk sheet is always a great and safe choice. But, there is definitely a trend toward uncoated sheets.

Large corporations are aiming to portrait a softer, more understated image. With fluorescent inks and knowledgeable prepress technology, the natural surface of uncoated papers is an ideal background for four-color process printing.

The paper is not only there to give the ink a foundation, but to enhance the design of the image you want to portray. A great example is the Eddie Bauer piece that fits the company?s personality to a ?T.? The texture and feel of the uncoated Neenah stock gives the impression of a sketchbook or diary kept while on a relaxing trip through the great outdoors.

Create a special interest even with a one-color print job. Don?t shy away from trying something new, like unusually textured or specialty papers that already are a trend in Europe and are gaining more and more popularity here. Connecticutt Foreclosure Procedure

Connecticut foreclosures are performed by the courts in a Judicial proceeding with two (2) alternative methods of foreclosure: (1) Strict Foreclosure and (2) Foreclosure By Sale. The reason that there are two alternative methods of foreclosure is simply a matter of equity in the property. If there is no equity in the property, the property will be given to the bank under the strict foreclosure procedure. The rationale for this type of outcome instead of a foreclosure by sale is that there will be no money to distribute after a sale. This determination is made by the judge in the particular case.

NOTICE OF INTENTION TO FORECLOSE (breach letter)

If the lender wants to chase the homeowner for any loss suffered as a result of the auctioning of the property at less than the amount owed on the mortgage, it must send the breach letter described in the previous chapter. The lender must also comply with the Promissory Note provisions and mortgage provisions as well as, the Federal Fair Debt Collection Practices Act 15 USC 1692.

FILING A COMPLAINT TO FORECLOSE

Prior to filing a complaint to Foreclose the attorney representing the bank will cause a title search to be completed to ascertain the names of all lien holders on the property. All lien holders will be made party defendants in the foreclosure complaint. The complaint will be filed in the County Superior Court and will recite the facts of the mortgage, referring to the Volume and page # of the Land record and the fact that the mortgage has been breached and is still due and owing. The bank will then request alternative judgments requesting possession, a deficiency judgment, and strict foreclosure.

The form of the complaint is given to the attorney by the Superior Court. The complaint will require a notice to all people unemployed or underemployed who owned a property continuously for two years that they may be entitled to relief pursuant to Connecticut G.S. 49.31W.

Return Date

Connecticut requires that the with the summons and Complaint be served upon each defendant twelve (12) days before the return date. The return date is set by the banks lawyer and requires the parties to file an appearance with the Court. Connecticut, unlike many other states requires the complaint to be served prior to the complaint actually being filed with the court.

Default JUDGMENT

In order to foreclose upon a property the plaintiff needs to receive a default judgment or if contested a summary judgment hearing or a trial will be held establishing the debt. There are three (3) ways to obtain a default judgment against the defendant: 1) Failure to appear; 2) failure to disclose a defense; 3) failure to plead.

Failure To Appear The defendants must file an appearance within two (2) days of the return date ( ten days from receipt of the summons. Failure to do so, will allow the bank to get a judgment by default.

Failure To Disclose A Defense

This default is only available when the debtor ( homeowner) has a lawyer representing him. If the homeowner has a lawyer and fifteen (15) days have passed since the return date, the banks lawyer will file a demand for the disclosure of a defense. If the attorney for the homeowner fails to disclose the defense within five days, then a motion for default can be filed and will be granted if no defense is disclosed prior to the hearing.

Failure To Plead

If the homeowner is representing himself and has not filed a response within the fifteen days then a motion for default will be filed and the homeowner will be defaulted if a pleading is not generated before the hearing.Once the defaults have been entered the bank can move for a judgment.

Motion for Judgment After receiving the default, the lender or its attorney will file a motion for Judgment. The judgment must have the following documents attached to it.

1) Original Promissory Note

2) original mortgage

3) all original assignments

4) A real estate appraisal with an oath;

5) military affidavit;

6) affidavit of debt

7) affidavit that the lender does not participate in the Connecticut Emergency Mortgage Assistance Program. Once filed it normally takes seven (7) to fourteen (14) days to get the motion on the foreclosure calander.

JUDGMENT HEARING STRICT FORECLOSURE OR FORECLOSURE BY SALE

A judge at the judgment hearing will decide if the property needs to be set down for a sale date of for a law day based upon the documents presented.

When It's All Yours: The Quit Claim Deed Form

In real estate, there are times when the property being ?sold off? does not rightfully belong to the ?owner?. This occurs when the property in question either belongs to the government (and the owner is holding a lease hold right), or when the property was not transferred properly (by death or other factors) from the previous owner to the end user. When you are involved in a transaction such as this, you have to make sure that when you indeed, decide to sell the property, the next owner will be assured that everything will be theirs. They have to be confident in knowing that three or four months down the line, no one will come knocking at their door claiming the property to be theirs. Verbally reassuring them is not enough, in situations such as this, the best form of reassurance you can give the new owners is a statement formalized via a Quit Claim Deed.

A Quit Claim Deed (otherwise called Quick Claim) is one that is used when you are releasing all your claims on the property. This document also serves as proof that you are the sole person who had the right to use the property no one else will lay claim to it later on.

When preparing a Quit Claim Deed, you have to make sure that all the important information concerning the transaction is noted down. The usual data include the names of the parties involved in the sale, a short description of the property (including the address or location), the agreed upon purchase price, and most importantly, a statement affirming that you are releasing all rights, interests and claims to the said property. To make the document legal and binding, you and the buyers (in front of third party witnesses) are obliged to affix your signature on this piece of paper. Later on, this document should be sent to a legal office where it should be notarized.

Quit Claim Deeds are fairly easy to prepare. You don?t need to go to a realtor or a lawyer just to have them draft you a copy. You can make one yourself. If you are unsure about the layout or the contents, you can research about it or just look for ready made forms that you can use or base your Quit Claim Deed on.

Finding a standard Quit Claim Deed layout is quite easy. There are libraries you can go to and real estate offices you can visit. However, if you don?t have time to make these out of the way trips just to get a Quit Claim Deed, you can just log on to the internet and simply download one. French Property Purchase the Compromis de Vente: What it is and Why You Should Want to Know

This is the preliminary contract between the buyer and vendor which sets out the exact conditions under which the Acte de vente will be completed and how the transfer of the property will take place.

It is a binding contract that is signed before any conveyancing takes place by the notary.

There is, however, a seven day cooling off period during which the purchaser may pull out without forfeiting any of his deposit (usually 10% of the purchase price). This period begins from the time the buyer receives a signed copy of the compromise and if you decide to pull out of the transaction then you must inform the notaire by written confirmation BEFORE the seven days are over. The buyer does not have to give any particular reason for this and should expect your deposit returned to you within 21 days of the notaire receiving the letter. It must be noted though that if the purchaser pulls out of the deal after this period then you are liable to losing the deposit unless any of the conditions suspensive (conditional clauses) are not met.

The Compromis de vente can be signed either at the estate agency itself or at the notaire's office. It can be drawn up by the estate agency or by the notaire - it is always safer to sign one prepared by a notary as it is more likely to protect you and include more details on the transaction.

The notary should spend some time with you on the details of the transaction and outline any conditions suspensives such as the contract being subject to mortgage approval for example.

Information held within the compromis:

? Details of the purchaser and vendor- You will be asked to provide information on your civil status which includes the following: Full names, contact details, passport copies, professions, birth and marriage certificates and details of ex spouses

? Title details of the property

? A description of the property and a map of the plot showing its exact location within the commune shown by the plan cadastral showing the borders of the property and what buildings are included in the purchase

? The price of the property

? The agreed deposit which is usually 10% of the price of the property (excluding the estate agent's commission). This deposit will normally be held by the appointed Notaire and should be in his account upon signing so be prepared and make sure that you have enough cleared funds to do this

? Circumstances when the deposit may be forfeited (e.g if the buyer pulls out AFTER seven days of receiving the copy of the signed Compromis)

? Declarations by the vendor and obligations of the purchaser

? Certificates of lead, asbestos and termite surveys (detailed below) or arrangements for them

? Conditional Clauses that must be fulfilled in order for the sale to take place. These include the standard clauses pertaining to the searches conducted by the Notaire (e.g limitation on the property being used for its intended purpose), claims on the Title, mortgage acceptance etc. Also additional clauses can be inserted if agreed by both parties such as building work to be completed or servicing of boiler, planning permission etc.

? Penalty clauses describing what action is taken if either side fails to fulfil his/her part of the deal

? Declarations on both the buyer and seller's capability to fulfil the contract

? Details of (Frais de Notaire) Notary fees

? Target completion date

? Inventory of items included in the sale

Fortunately in France the law states that the vendor is under a legal obligation to not withhold any information form the buyer and thus the purchaser is very well protected. This includes the following information necessary for the signing of the compromis to take place:

1) The asbestos survey - Any property built before the 1st of July 1997 must be accompanied by a certificate detailing whether or not asbestos is present in the building materials used in its construction which is valid for one year

2) The termite certificate - The vendor must show a certificate dated within the last three months showing the absence of termite infection within the property. If the certificate shows that there are in fact termites in the building then he must eradicate them at his own expense and provide a new certificate showing that the building is now free from termites

3) Lead certificate - If the property was built before January 1st 1948 and is located in an area which has been identified by the prefecture as an at risk area for containing lead then a certificate must be produced showing its presence or not

4) Certificat de la loi Carrez - A certificate showing the surface area of each house or flat in a co-owned property

Those four certificates above are essential to have before the compromis is signed and they are all provided by the vendor. Additional information set out below must also be supplied by the vendor as the notaire carries out the conveyancing:

1) The rental status of the property

2) A certificate to show that the property conforms to the building regulations

3) The building permission for the property

4) Whether or not the property has construction insurance if it is less than ten years old or if it has had some work done to it in the last ten years

5) The heating system

6) The gas supply

7) The safety standard of the swimming pool

8) The drainage system

It is also useful for the buyer to check to see if there is any planning permission on adjacent or nearby property and find out exactly what it is so that you know you are not buying something that will for example shortly have a high rise apartment block built next to it. You can do this simply by visiting the local Mairie (town hall) and asking for it.

A Writing Enterprise

Judith and Garfield Reeves-Stevens came to Hollywood to write. While in town, they managed to tear down some common entertainment industry assumptions.



Common wisdom says husbands and wives shouldn't work together. But, they are a very successful and inseparable writing team. Industry tradition holds that you have to be 20 years old and fresh out of college to write for television. However, there's no way anyone fresh out of college could have piled up the credits this pair did before arriving in network TV. Finally, Hollywood insists that the nice guys finish last ? while the Reeves-Stevenses get work as much for their professional pleasant temperament as their considerable talent.



As co-producers on Enterprise, the last production in Paramount Star Trek television franchise, they were part of a team charged with recharging a series that struggled in its third season. They helped to improve the show by leaps and bounds, though the ratings damage was already too late.



At first impressions, the Reeves-Stevenses seem an unlikely choice for such an important TV task as forging the plot-lines of Star Trek. They seem far too nice to have found so much success in Hollywood. They're the kind of polite, soft-spoken Canadians you'd expect to find running a bed and breakfast in Niagara ? not writing screenplays, TV scripts, novels and non-fiction books.



As writers, we didn't make changes to the show, Garfield said. Executive producers Rick Berman and Brannon Braga and show-runner Manny Coto planned the overall direction of the series and made any changes to the mythos.



Our job was to provide good stories that stick to Star Trek continuity. It's to our benefit that we know that continuity after writing Star Trek books for 10 years. In TV, we're telling a more compact story with clearer rules. For television, we were writing a Star Trek tale in a more linear mode, but the themes remain the same ? the ideas of exploration and an optimistic future.



He added, Those themes played a big role with Enterprise because this world is still new.



Both writers said there was no over-riding plan or need to recreate Enterprise after its first three years.



The entire team felt that it was more a matter of taking what had been established in seasons 1, 2 and 3 and making sense out of that rather than recreating the show into season 4, Garfield said. In Next Generation, halfway through the series, they made a deliberate decision to invoke the name of Spock ? finally naming a character from the original series. They wanted to establish that show as distinct before introducing other past elements.



The same decision was made for Enterprise. If the first season had been so devoted to prequels and tie-ins, it never would have got on its feet for the same story.



Before being recruited onto the Paramount lot, the Reeves-Stevens wrote several Trek novels, including several with William Shatner featuring the continued adventures of James T. Kirk. On, their own, they're a pair of New York Times and Los Angeles Times bestselling novelists with dual fascinations with NASA and science fiction. Their books are published in the United States, Canada, and England, and in translation in Czechoslovakia, France, Germany, Holland, Israel, Italy, Japan, Poland, Russia, Spain, and the Ukraine.



In TV, the Reeves-Stevenses were staff writers for the second season of Sir Arthur Conan Doyle's The Lost World - the syndicated one-hour action-adventure series from New Line. For the series' third season, the Reeves-Stevenses returned as supervising producers on location in Australia. In other episodic work, the Reeves-Stevenses have written for John Woo's Once a Thief, The Hitchhiker, MTV's Catwalk, and Beyond Reality.



The team's experience in science fiction made them a natural choice for work on Enterprise: It was easier for us to come into Star Trek than it might be for other sci-fi writers, Judith said. Even though they are all very talented and very well-informed on sci-fi, they might not be up to date on all of the Star Trek continuity.



While writing the Star Trek books, you explain events in the mythos that are still open to interpretation. Now, Enterprise is doing the same thing ? such as explaining the origin of Klingon head bumps from the original series to the Star Trek movies.



Garfield explained that in Star Trek lore, what happens on screen is considered narrative canon, while anything in books, comics or video games is superfluous.



It was a challenge for us to add to the ?canon,' he said.



Judith added, Writing for Star Trek was interesting for us also because we'd written for all of the other Star Trek eras, but we hadn't written for these characters yet. We wondered how quickly we could get the voices of these characters. But, we had the ability to go down to set and watch the actors.



According to Judith, there were other adjustments the pair had to make to their writing and working routine: Well, we had to start getting up in the morning and going into an office. We obviously write our books out of our home.



Garfield added that Enterprise also offers a much faster process than their book work. The team has three books coming out this year, and the writing of one (Going to Mars) was a six-year process.



Writing for TV is great for almost instant gratification because you write a script, and ? five weeks later ? it's on TV. During that process, you're coming into the office, working on a script and taking meetings only on the script you're working on. But, you watch the sets get built, watch the dailies, come in, etc.



It helps that it was the 25th season of Star Trek in production, he added. So it was a well-oiled system we were watching.



The nicest thing for us was that we knew the people involved through writing the books over 10 years, Judith said. We were talking to them about their jobs. We were able to see all aspects of the working company. We were able to ask questions that a writer working on a script might not be able to ask.



So, we came on board as writers and co-producers, it felt as though we were really joining old friends.

July Foreclosure Activity Increases

There was an 18% year-on-year increase in July foreclosure filings, according to RealtyTrac. The month saw 92,845 filings.

That is one new foreclosure filing for every 1,245 households.

While foreclosure activity continues to remain slightly below historical averages, there looks to be a significant amount of upward pressure on foreclosure rates in the next few months, siad James J. Saccacio, chief executive officer of RealtyTrac.

First, the billions of dollars in ARMs projected to reset in the third and fourth quarters could increase monthly mortgage payments for many homeowners, Saccacio explained. And the cooling real estate market exacerbates the problem for these homeowners by making it tougher for them to sell at a high enough price to pay off their loan balance.

Colorado had the highest rate of foreclosures in the country, with a new foreclosure filing for every 480 households. The state has had the highest foreclosure rate for five straight months.

Colorado saw an increase of 3% in foreclosure filings for the month, and a 55% increase for the year. The state reported 3,810 households entering some form of foreclosure.

Nevada had the second highest foreclosure rate for the second month in a row. There was one new foreclosure filed for every 533 households. There was a 31% increase in foreclosures for the month with 1,626 households entering some stage of foreclosure.

Texas led the country in the most foreclosures with 12,103 filings. The state has remained in this position for eight consecutive months. There was a 15% increase in foreclosures when compared to June.

Six states, including Texas, Florida, California, Michigan, Ohio and Illinois, represented 54% of the nation's foreclosure activity in the past month.

Home Sales Likely To Level Out

According to the National Association of Realtors, home sales are likely to level out during the next few months.

The Pending Home Sales Index indicates sales that sill be finalized within the next couple of months. Based on the contracts signed in July, the PHSI is down 7.0% for the month. On a year-to-year basis, the index is down 16%.

An index of 100 is the average level of contract activity during 2001 -- the first year of the index. July's index was 105.6.

"In looking at year-to-year comparisons, the pending home sales index has been very close in predicting the actual pace of home sales," NAR chief economist David Lereah said.

"Based on recent changes from a year ago, the index shows existing-home sales should continue to ease after a stronger-than-expected decline in July, but are likely to flatten in the months ahead."

Lereah continued to say that psychological factors could be attributing to slowing July home sales.

"We've never seen a general decline in the housing market against a healthy economic backdrop where jobs are being created, the economy is growing and interest rates are favorable," he explained.

"Pyschological factors are causing some buyers to remain on the sidelines, waiting for prices to stabilize or for more favorable news about the market and the economy. Contributing to this hesitency is a lot of negative news stories, but in the end we believe that underlying market fundamentals will prevail."

The PHSI for the West saw a decrease of 5.5% for the month and 20.3% for the year. The South experienced a decline of 6.4% for the month and 11.3% for the year. The Northeast PHSI dropped 7.7% for the month and 15.5% for th year. The Midwest index fell by 9.0% for the month and 20.1% for the year.
